
Booking Terms & Conditions

1. Introduction
These Terms and Conditions govern all services provided by Chris Overland Photography (“we”, “us”, “our”) to the client (“you”, “your”).
By booking our services, you agree to be bound by these Terms and Conditions.
2. Booking and Confirmation
Bookings can be requested via our website or by email.
A booking will only be considered confirmed once the date and time, services required and quoted fee have been agreed in writing by both the client and Chris Overland Photography.
By confirming a booking, you agree to these Terms and Conditions.
We reserve the right to decline a booking where we are unable to provide the requested services or where reasonable circumstances prevent us from accepting the booking.
3. Pricing and Payment
All services are charged as quoted.
An invoice will be issued following completion of the photography session.
Full payment is required before final edited images are released.
Payment is to be made via bank transfer or payment link.
We reserve the right to charge interest on overdue payments where applicable.
4. Cancellations and Rescheduling
We understand that circumstances can change. If you need to cancel or reschedule a booking, please provide as much notice as reasonably possible.
More than 48 hours’ notice: No cancellation charge.
Less than 48 hours’ notice: A cancellation charge of up to 50% of the agreed fee may apply.
Same-day cancellation or failure to attend: A cancellation charge of up to 100% of the agreed fee may apply.
Any cancellation charge will take into account the circumstances of the cancellation and any reasonable costs or loss incurred as a result.
Where possible, we will offer the opportunity to reschedule the booking rather than cancel it.
We reserve the right to reschedule a booking where circumstances beyond our reasonable control prevent us from providing the service, including adverse weather, illness, travel disruption or other unforeseen circumstances. Where this occurs, we will work with the client to arrange an alternative date.
Nothing in this section affects any statutory cancellation rights that may apply under applicable consumer law.
5. Property Access and Readiness
If we are unable to carry out the photography session due to lack of access, the property not being ready, or the keyholder not being present, a cancellation or rescheduling charge may apply in accordance with Section 4.
6. Image Delivery
Edited images will normally be delivered within 3 working days of the photography session, unless a different timeframe has been agreed in writing.
Images will be delivered via a secure online download link, such as OneDrive.
Turnaround times may be extended in exceptional circumstances, including unusually high workloads, technical issues or circumstances beyond our reasonable control. Where this occurs, we will inform the client as soon as reasonably practicable.
The client is responsible for downloading and securely storing the images once they have been delivered.
7. Image Storage
Final images and floorplans will be available for download for 3 months from the date of delivery.
After this period, we are not obligated to retain copies. Clients are responsible for securely storing their files once delivered.
8. Copyright and Usage
All photographs and floorplans produced by Chris Overland Photography remain the copyright of Chris Overland Photography.
Once full payment has been received, the client is granted a non-exclusive licence to use the photographs and floorplans for the marketing and promotion of the relevant property.
This includes use on property listing websites and portals such as Rightmove and Zoopla, estate agency websites, social media, brochures, advertisements and other reasonable marketing materials relating to the property.
The client may not sell, sublicense or transfer the photographs or floorplans to another party for their own commercial use without prior written permission from Chris Overland Photography.
Photographs and floorplans must not be materially altered or edited without prior written permission, other than reasonable cropping or resizing required for standard property listings or marketing purposes.
Copyright ownership remains with Chris Overland Photography at all times.
9. Floorplans
Where floorplan services are provided, floorplans are produced for illustrative and property marketing purposes only.
Measurements, dimensions and layouts are approximate and are not guaranteed to be accurate. Floorplans are not to scale unless specifically stated.
Floorplans must not be relied upon for legal documentation, architectural or structural decisions, property valuation, building work or professional surveys.
The client is responsible for independently verifying any measurements or dimensions where accuracy is required for a specific purpose.
Chris Overland Photography will take reasonable care when producing floorplans but accepts no responsibility for inaccuracies arising from measurements, information or access available at the time of the photography appointment, except where liability cannot legally be excluded or limited.
10. Portfolio and Marketing Use
We will not use images or floorplans for portfolio or marketing purposes without your prior consent, in line with our Privacy Policy.
11. Limitation of Liability
We take all reasonable care in delivering our services and producing the agreed materials.
We will not be liable for any indirect or consequential loss, including loss of sales, profits, business opportunities or other commercial losses, except where such liability cannot legally be excluded or limited.
Our liability will be limited to the extent permitted by law and will not affect any rights or remedies that you may have under applicable consumer law.
12. Weather Conditions
Where weather conditions are likely to significantly affect the quality or safety of exterior photography, we may recommend that the photography session be rescheduled.
We will discuss any proposed rescheduling with the client and, where possible, arrange an alternative date that is suitable for both parties.
Where weather conditions do not prevent the photography session from taking place, the session may proceed as planned. We cannot guarantee specific weather conditions or the appearance of exterior photographs where weather is beyond our control.
13. Force Majeure
We shall not be held liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to:
Severe weather
Illness
Travel disruption
Equipment failure
14. Complaints
Clients are encouraged to raise any concerns or issues as soon as reasonably possible after delivery so that we can investigate and resolve them promptly.
We will make reasonable efforts to resolve any issues fairly and within a reasonable timeframe.
Nothing in these Terms and Conditions affects any statutory rights you may have under applicable law.
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
