1. Introduction

These Terms and Conditions govern all services provided by Chris Overland Photography (“we”, “us”, “our”) to the client (“you”, “your”).

By booking our services, you agree to be bound by these Terms and Conditions.

2. Booking and Confirmation

Bookings are requested via our website or email.

A booking is considered confirmed only once we have:

Agreed a date and time in writing, and

Received acceptance of the quoted services

We reserve the right to decline or cancel a booking at our discretion.

3. Pricing and Payment

All services are charged as quoted.

An invoice will be issued following completion of the photography session

Full payment is required prior to delivery of final images.

Images  will not be released until payment has been received in full

Payment is to be made via bank transfer or payment link.

We reserve the right to charge interest on overdue payments where applicable.

4. Cancellations and Rescheduling

More than 48 hours’ notice: No charge

Less than 48 hours’ notice: 50% of the agreed fee may be charged

Same-day cancellation or failure to attend:  100% of the agreed fee may be charged

We reserve the right to reschedule bookings due to circumstances beyond our control, including but not limited to adverse weather or illness.

5. Property Access and Readiness

The client is responsible for ensuring that:

The property is accessible at the agreed time

The property is clean, presentable, and ready for photography

We are not responsible for moving items, cleaning, or staging the property.

If we are unable to carry out the shoot due to:

Lack of access

Property not being ready

Keyholder not present

The full fee or a rescheduling fee may be charged.

6. Image Delivery

Edited images will typically be delivered within an agreed timeframe

Delivery is made via a secure online download link (e.g. OneDrive)

Turnaround times may vary depending on workload and project scope

7. Image Storage

Final images and floorplans will be available for download for 3 months from the date of delivery.

After this period, we are not obligated to retain copies. Clients are responsible for securely storing their files once delivered.

8. Copyright and Usage

All images and floorplans remain the copyright of Chris Overland Photography.

Upon full payment, the client is granted a non-exclusive licence to use the materials for their intended purpose (e.g. marketing or listing a property).

Materials may not be:

Sold or transferred to third parties without permission

Altered or edited without prior consent

9. Floorplans

Where floorplan services are provided:

Floorplans are supplied for illustrative and marketing purposes only

Measurements, dimensions, and layouts are approximate and not guaranteed to be accurate

Floorplans are not to scale unless explicitly stated

They must not be relied upon for: Legal documentation, Architectural , structural decisions, Property valuation or surveys.

It is the client’s responsibility to independently verify all measurements.

We accept no liability for any loss arising from the use of floorplans.

10. Portfolio and Marketing Use

We will not use images or floorplans for portfolio or marketing purposes without your prior consent, in line with our Privacy Policy.

11. Limitation of Liability

We take all reasonable care in delivering our services. However:

We are not liable for any indirect or consequential losses (including loss of sales or business opportunities).

Our total liability shall not exceed the total amount paid for the services.

12. Force Majeure

We shall not be held liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to:

Severe weather

Illness

Travel disruption

Equipment failure

13. Complaints

Any concerns or issues must be raised within 48 hours of delivery.

We will make reasonable efforts to resolve any issues promptly.

14. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.
